Hotel contract


Party A: the first party is: the first, the second and the third.

In accordance with the relevant laws and regulations of the state, the relevant policies of provinces and municipalities, and the spirit of Party A's relevant documents, combined with the actual situation of enterprises, and in line with the principle of seeking truth from facts, sincere cooperation and mutual benefit, the two sides jointly sign a contract for the contract of teaching and learning of hotels (hereinafter referred to as the contract).


Second, Party A will hand over the whole service management right of the hotel to Party B.

Party B shall bear the creditor's rights and liabilities and the economic, safety and legal responsibilities arising from it.

Fourth Party B should strictly refer to the standards of tourist hotels and restaurants in accordance with the relevant policies of provinces and municipalities and the relevant provisions of the public security departments.

Giving priority to arranging the reception work of foreign guests, teaching, scientific research and other work, as well as various conferences and services undertaken by the school, in the reception of the headmaster's class and other provinces and cities, the accommodation standard is charged at 10% of the lowest price at that time (the difference between the actual fee standard and the above provisions is signed by the college). In order to ensure the above tasks, we should look for opportunities, expand the market, tap the potential and strive for greater economic and social benefits.


Fifth Party A shall supervise the rational use of the assets of the college and assist Party B in coordinating the work of the foreign party.


The second chapter is the base of contract.


The sixth annual contract fee of Party B is RMB 500 thousand yuan, and the total contract fee of five years is 2 million 500 thousand yuan RMB. The contract fee is 500 thousand RMB yuan at the end of May of each year. If the time limit is not paid, Party A has the right to collect late fees according to 3/1000 of the monthly payment.


The seventh contract numbers consist of cash, bank pfer and school signing.

About the school's signing and closing accounts: all forms of checkout within Party A are based on the signing of the hospital office.


The third chapter is about the term of contract.


The eighth contract is valid for five years.

After signing the contract, Party A will give Party B eighty days' decoration time, and the contract fee will be exempted.


When the ninth contract expires, Party B can voluntarily renew the contract on completion of the payment, but Party B shall submit to Party A a renewal of the application in written form in six months before the expiry date.

Under the same conditions, priority is given to renewal.


The fourth chapter: rights and obligations of the two sides.


Tenth rights of Party A


1. Legal ownership of assets pferred to Party B's property, facilities, equipment and other assets under contract management and operation, and the right to supervision.

Four, Party B shall bear the criminal liability and civil liability for compensation independently in accordance with the contract and relevant laws and regulations for Party B's injury accidents, food poisoning and other major safety incidents due to Party B's causes, and Party A shall have the right to supervise and urge.


Eleventh obligations of Party A


(1) to provide Party B with existing facilities and facilities approved by Party A and B (the detailed property is pferred to the property list).

Three, assist Party B in making efforts to coordinate the work in the contract period.

Six, when the college needs to adjust the use of housing in a macro way, it has the right to change or terminate the contract ahead of time.


Seven, the maintenance of the water supply and drainage system of the hotel should be handled by Party B and bear the corresponding cost.


Twelfth rights of Party B


1. During the contract period, Party B has the right to use the contract and the equipment must be kept intact.

If the natural damage facilities are full, the Party B shall report it to Party A in time for approval, and Party B shall not handle it without authorization.

Two, have the right to operate independently and within the scope of the contract.


Three, if Party B needs to rebuild and renovate the guesthouse and the new business premises in the hotel area, it is necessary to put forward a renewal plan and a new plan in advance. It must be approved by Party A's examination and approval before it can be implemented (over 15 working days without reply, as agreed).

The batch purchase of fixed assets investment (mainly refers to equipment renewal) should be reported to Party A in advance.

The principle of piecemeal purchase without prejudice to Party B's operation, improvement of operational efficiency and reduction of approval procedures can be confirmed by Party A afterwards.

The Audit Office annually conducts an audit of hotel renovation and renovation and fixed assets investment.

Otherwise Party A shall have the right to investigate Party B's liability for breach of contract (to be punished by 2 times the actual loss).


Four, if Party B is engaged in financial activities such as mortgage loan and other intangible and tangible assets, it must be approved by Party A, otherwise Party B's legal and financial responsibilities will be investigated.


Thirteenth obligations of Party B


First, the hotel should not be pferred to the third party in the course of business operation. Once discovered, Party A has the right to terminate the contract at any time and to hold Party B's liability for breach of contract.


Two, responsible for the renovation and renovation of hotels, the first investment of not less than 800 thousand yuan (whichever is approved by Party B for approval and maintenance and pformation plan), and Party B's investment in renovation and purchase of equipment within five years shall not be less than 1 million 100 thousand yuan RMB. Based on the audit results, the pformation funds invested less than 1 million 100 thousand yuan in five years should be filled in cash.

Party A is responsible for the custody and maintenance of assets pferred by Party A.

In addition, Party B has the right to dispose of the equipment due to the need for operation and the expiration of the contract.


Three, we must do a good job of hotel service in strict accordance with the provincial and Municipal Hotel standards, strengthen the training of service skills of employees, fulfill the commitment to staff training costs, and continuously improve the professional quality and service quality of employees.

We should standardize customer service, conscientiously do well in customer complaints, and strictly implement the procurement procedures and quality assurance system for hygiene and cleaning products and food.


Four, honest management, establish a good corporate image and establish a good society.

Consciously abide by the relevant regulations of the state on special industries, and pay the cost of water, electricity and steam at the cost price approved by Party A on time.


Five, do a good job in the operation of the security work, especially to strictly enforce the fire and food, health, safety and other work, consciously accept the supervision and inspection of the relevant departments.

Party B shall report to Party A the working standards for fire safety, food hygiene, safety and property safety during the operation period. If Party B is responsible for fire, food poisoning, industrial accidents and other malignant cases, Party B must bear legal liability and economic responsibility solely. Party A has the right to unilaterally terminate the contract and bear no liability for breach of contract if the circumstances are particularly serious.


Six. Party B must carry out business promotion and advertising arrangements on campus for the sake of business needs.

Implementation


The fifth chapter is liability for breach of contract.


The fourteenth parties violating the terms and conditions of this contract are breach of contract. The covenant is entitled to investigate the legal liability and economic responsibility for breach of contract in accordance with the contract documents and the economic contract law of the People's Republic of China.


The Fifteenth Party must unilaterally or in the event of a major school decision to terminate the contract ahead of time. It should give written comments to the other party 2 months in advance. The penalty for breach of contract without any reason or serious breach of contract is 500 thousand yuan.


Sixteenth, considering the high cost of the initial renovation and renovation of the second party, the 500 thousand yuan paid in the first two years will be paid up in the next two years, that is, second yuan will be turned over to 700 thousand yuan, and 800 thousand yuan will be paid in third years.

According to the above standards, Party B may terminate this contract if Party B fails to pay 80% of the contracted amount of the college or fails to complete the contract fees payable on time in two consecutive years.


The sixth chapter is dispute resolution.

The seventeenth is for the disputes between Party A and B in the execution of the contract, the two sides should be realistic.

Seventh chapter supplementary provisions


Eighteenth matters not covered by this contract can be amended according to the relevant provisions of the economic contract law of the People's Republic of China, and shall be supplemented separately after consultation.

If there is any discrepancy between the contract and the newly promulgated regulations and documents, the state regulations shall prevail.


The nineteenth article will enter into force after signing and sealing the contract.
